The Future is unpredictable and no one likes to think that at some stage in their lives they will not be able to make their own decisions or will need help carrying out day to day activities but unfortunately this is very common, it could be through old age, illness or injury. Lasting Powers of Attorney are legal documents that can authorise people you trust to make decisions on your behalf. this could be because you can no longer make decisions yourself or it may just mean you want a family member to act on your behalf to deal with certain matters such as dealing with your bills or your banking.
A lasting power of attorney is an essential part of estate planning and must be made while you still able to make your own decisions, it can be created to take effect either immediately or when you have lost mental capacity depending on your preferences.
If you do not have a Lasting Power of Attorney in place and you lose mental capacity, have a stroke, an accident or are hospitalised then no one automatically step in to make decisions for you. · Making gifts on your behalf (charities)
· Tax planning
Health and Welfare Lasting Power of Attorney
This allows your Attorney to make decisions on your behalf such as:
· Deciding on appropriate care & place of residence as appropriate.
· Deciding on your permanent place of residence.
· Consenting to or Refusing medical treatment for your benefit
· Choosing your social activities
· Deciding on the level of care you may need.
· Making decisions about diet and personal appearance.
